Alive App Terms of Use

1. Introductory Provisions

1.1. The purpose of these Alive App Terms of Use (the “Terms of Use”) is to govern the rights and obligations of the Alive App operator and user.

1.2. By using the Application, the User agrees and undertakes to comply with these Terms of Use; moreover, the User acknowledges and represents that he or she understands the information about the processing of personal data pursuant to the Alive App Privacy Policy (here in after the “Privacy Policy”).

1.3. By accepting these Terms of Use, the User concludes a contract for the provision of Application services with GTS Alive Group.

1.4. The content of the services is provided free of charge, unless the User is notified of any paid service in advance and agrees with such service by accepting separate terms of use.

1.5. The Alive App uses cookies and other similar tools. For detailed information, see our Cookies Policy (here in after the “Cookies Policy”).

2. Operator and Contact Details

2.1. The Alive App mobile application (the “Application” or “Alive App”) is set up and operated by GTS ALIVE Group s.r.o., identification number (IČ): 09296727, with its registered office at Na Maninách 1092/20, Holešovice, 170 00 Prague 7, registered in the Commercial Register maintained by the Municipal Court in Prague, section C, entry no. 334013 (“GTS Alive Group”).

2.2. Operator’s contact details:

3. User

3.1. The Application is intended for all individuals without restrictions (the “User”), including holders of any of the cards issued by the Alive Profile operator, based on the selected country (the “Card”).

3.2. The Application is also intended without restrictions for all persons that use other services provided by the Alive Profile operator in the relevant country.

3.3. Any use of the services by a user under the specified legal age provided for by the applicable legislation in each individual country shall be subject to approval by the person exercising parental supervision. 4. Application Functionalities

4.1. The purpose of the Application is to provide a digital ID card, access to an individual Alive Profile that would keep and display any issued ID cards and cards, purchased insurance products, and other functionalities.

4.2. Overview of functionalities:

  • Discount search = this function will show you the nearest partners providing discounts or benefits for selected Cards; the relevant results can be sorted according to various criteria;
  • Possibility to access an Alive Profile in different countries;
  • Verification of e-identity via email for the possibility of using Card-related services;
  • Language selection based on device settings;
  • Preferred country selection based on device settings;
  • Application Notifications, Login
  • Functionalities available after activating/signing-in to Alive Profile, such as access to Cards or other services, depending on the Alive Profile terms of use.

4.3. A detailed explanation of the functions and information about the processing of personal data is available in the Privacy Policy.

4.4. The Application contains tools to ensure the security of the Application and to protect the Application and the User from automated programs and external attacks. For more information, see the Cookies Policy.

4.5. The Application also allows the use of analytical, statistical, and remarketing tools. For more information, see the Cookies Policy.

4.6. The User acknowledges that the functionalities available after signing-in to a single profile that includes the Alive Profile user interface (the “Alive Profile”) are governed by the terms and conditions for the Alive Profile management and are not governed by these Terms of Use. The terms of use for the Alive Profile are available here. The Alive Profile is not operated by the same person as the Application. The User expressly acknowledges that GTS Alive Group is not responsible for the Alive Profile operation. These provisions shall apply mutatis mutandis if you sign-in to an Alive Profile managed in another country, based on the User’s selection. GTS Alive Group shall not be responsible for the Alive Profile availability and effective performance. Furthermore, GTS Alive Group shall not be responsible for ensuring the Alive Profile availability in all countries in the world; access shall only be provided in countries where individual operators operate the Alive Profile.

4.7. The User acknowledges that the Alive Profile is operated by a different company in each country. For the overview of contacts and identification of operators in individual countries, please consult the terms of use for the relevant country – the overview is available here.

5. Using Alive App

5.1. When using the Application, the User shall obtain detailed knowledge of and comply with these Terms of Use.

5.2. The User agrees that any data and declarations to be provided or made will be true, accurate, and complete.

5.3. The User undertakes to protect its device and Application access. In case of any risk, the User undertakes to notify GTS Alive Group without delay.

5.4. The User shall not cause damage to other Application users or impair the reputation of GTS Alive Group or its affiliates.

5.5. GTS Alive Group expressly prohibits any interference with the technical contents of the Application, any copies of the Application or installation of any software that interferes with the Application or alters its functionalities.

5.6. The Application contents, texts, graphics, software, and other aspects thereof, including the Application display and layout, are subject to copyright and used exclusively by GTS Alive Group. It is not possible to reproduce, download or otherwise distribute any contents without the express written consent of GTS Alive Group.

5.7. The User shall be fully liable for any damage or harm arising from the breach of these Terms of Use.

5.8. GTS Alive Group shall not be liable for any damage or harm arising in connection with the use of the Application by the User or third parties (whether with or without authorization).

5.9. GTS Alive Group shall not be responsible for the availability of the Application and/or any parts thereof.

5.10. The User shall not be entitled to any compensation for damage or harm due to the unavailability (even partial unavailability) of the Application or any functionality of the Application.

5.11. GTS Alive Group may carry out scheduled and unscheduled maintenance of the Application or any parts thereof; consequently, the Application or any part thereof may be unavailable.

6. User Authentication

6.1. In order to ensure that the User can securely sign-in to the selected Alive Profile, it is necessary to authenticate such User or verify such User’s primary email, as appropriate.

6.2. The authentication process shall be as follows:

  1. The User enters his or her email address and password and submits such data to activate his or her Alive Profile.
  2. The User receives a confirmation email for the purpose of verifying the provided email address. The User uses the relevant link to verify his or her email address.

6.3. The User shall create his or her access to the Application using the given email address and password (the “Application Login”). The Application Login protects User’s access to Alive Profiles; it is permanent to ensure easy use of Cards in individual countries. The User must create a strong enough password in accordance with the requirements of the Application; he or she shall protect such password, shall not disclose it to any third parties, and shall notify GTS Alive Group of any unauthorized use. The User undertakes to change his or her password regularly in the Application settings. If the User forgets his or her password, it can be reset using the Application.

6.4. Once the User is authenticated, he or she can sign-in to the selected Alive Profile of the relevant country at any time during his or her use of the Application. Information about the processing of personal data in connection with the User authentication process is available here.

6.5. User’s email address is verified in terms of its credibility – i.e. whether it exists and whether it is actually used by the User. The verification must be completed within 24 hours. If the verification email is not confirmed by then, the User must repeat the process.

6.6. The User shall be permanently signed-in to the Alive Profile in the Application for the purpose of using his or her digital card, unless the User signs out. If the User does not wish to be permanently signed in, he or she shall sign out from the relevant Alive Profile after he or she is done using the services. For this purpose, access is maintained in a secure manner in accordance with the Privacy Policy for each Alive Profile of the relevant country; the overview of such policies is available here. GTS Alive Group provides this functionality as a data processor for individual operators of Alive Profiles in individual countries.

6.7. Moreover, the verification is a necessary first step for ensuring the Alive Profile registration/activation and use of any services thereof. If the User fails to activate or register/sign-in to the Alive Profile within 24 hours from the email address verification, he or she will need to repeat the verification process before signing-in to the Alive Profile. If the User does not verify his or her email address, he or she can still use the Application as a website – i.e. as an information source.

7. Alive App Termination

7.1. The contract for the provision of services in connection with the Alive App shall remain in full force and effect, until terminated by the User and/or GTS Alive Group.

7.2. GTS Alive Group may cease the operation of the Application or alter the Application at any time.

7.3. Users may cease to use the Application at any time (and terminate the associated contract) by uninstalling the Application from all their mobile devices.

7.4. The contract is terminated once the uninstallation is complete and/or 7 working days from the notice of termination of the Application operation given by GTS Alive Group or after the User submits his or her request for termination to GTS Alive Group.

7.5. The Application functionalities specified herein cannot be used once the contract is terminated; consequently, the User will not have access to his or her Alive Profile, for example.

7.6. If the User does not agree with any change to the Terms of Use or Application functionalities or contents, he or she may stop using and uninstall the Application at any time.

8. Alive Profile Terms of Use

8.1. The User acknowledges that different administrators manage Alive Profiles in individual countries and services provided in connection with individual profiles may vary. The User usually registers his or her profile in a country, where his or her card was issued, whereas he or she may sign-in to his or her profile automatically. If the User travels abroad, he or she may activate a profile in another country and consent to the transfer of his or her personal data to another profile – i.e. to another data controller and profile operator.

8.2. Terms of use for Alive Profiles in individual countries, including information about age limits below which it is necessary to obtain consent of a person exercising parental supervision in each country:

Czech Republic:

  • Alive Profile administrator: GTS ALIVE s.r.o., with its registered office at Na Maninách 1092/20, Holešovice, 170 00 Prague 7, identification number (IČ): 26193272, Commercial Register registration: file no. C 78560 maintained by the Municipal Court in Prague;
  • Individuals under the age of 15 need the consent of their legal guardian to use the services;
  • The Alive Profile Terms of Use, including the information about age verification, are available here;
  • The Privacy Policy of the Alive Profile is available here;

Romania:

  • Alive Profile administrator: Asociatia pentru Sprijinirea Tinerilor, Studentilor si Profesorilor (ASYST), with its registered office at Str. Domnita Anastasia Nr. 10 Et. 3 Ap. 5, Sectorul 5, Bucaresti, Romania, Registry no.: 17531821, maintained by the ONRC (the National Trade Register Office – Romanian Chamber of Commerce and Industry);
  • Individuals under the age of 16 need the consent of their legal guardian to use the services;
  • The Alive Profile Terms of Use, including the information about age verification, are available here;
  • The Privacy Policy of the Alive Profile is available here;

United Arab Emirates, Oman:

  • Alive Profile administrator: GTS ALIVE ME DMCC, with its registered office at Unit No: 3928, DMCC Business Centre, Level No 1, Jewellery & Gemplex 3, P. O. Box: 392173, Dubai, United Arab Emirates, Licence Number: DMCC-073822, Registration Number: DMCC39822, Tax Registration Number: 100426366900003;
  • Individuals under the age of 18 need the consent of their legal guardian to use the services;
  • The Alive Profile Terms of Use, including the information about age verification, are available here;

United Kingdom of Great Britain and Northern Ireland

  • Alive Profile administrator: Student Discount Cards Limited, Registered at: Companies House, Cardiff , company number: 08873775, with its registered office at Merseyway Innovation Centre, 21-23 Merseyway, Stockport, SK1 1PN;
  • Individuals under the age of 13 need the consent of their legal guardian to use the services;
  • The Alive Profile Terms of Use, including the information about age verification, are available here;
  • The Privacy Policy of the Alive Profile is available here;

9. Provisions relating to digital content

9.1. This Article contains information on the functionality of digital content, including technical protection measures.

9.2. The functions of the Alive App represent digital content and, as such, are provided solely to the User.

9.3. The User acknowledges that the Application is not available for all types of devices / operating systems. To ensure full functionality, it is necessary to have a device or operating system (as appropriate) that meets the minimum requirements specified here.

9.4. The Alive Profile can only be viewed in the Application.

9.5. GTS Alive Group is not responsible for any non-functionality in the absence of sufficient hardware or recommended software.

9.6. An Internet connection with sufficient speed is required to use the Application; GTS Alive Group shall not be liable for any malfunction in case of low Internet connection speed.

9.7. 100% uninterrupted functionality is not guaranteed; GTS Alive Group has the right to perform routine maintenance, which is usually carried out with prior notice. Furthermore, GTS Alive shall not be liable for server or Internet outages or third party attacks; however, it will always make an effort to fix the problem. GTS Alive Group may intervene in connection with unexpected events and suspend the functionality of the content or the Application for a limited period of time.

9.8. GTS Alive Group may modify the design, features or system of the Application without prior notice.

9.9. GTS Alive Group makes every effort to protect the relevant content and has taken the following measures to do so: implementation of antivirus software and firewalls; security backups; internal IT guidelines and staff trainings; regular audits of implemented measures; data encryption; proper security through individualized access with secure passwords; automated monitoring; behavioral analyses to detect and prevent attacks; provision of secure storage sites and proper contracts with storage vendors.

9.10. The User is required to protect their access credentials and not to disclose them to third parties; furthermore, the User shall not open hyperlinks in messages from unknown senders (or in messages from known senders that seem suspicious at first sight) or download unverified or illegal software, and they shall use antivirus software on their devices and periodically change their passwords and properly update any software.

9.11. GTS Alive Group is not required to provide updates to the digital content.

10. Information for consumers

10.1. A consumer is any person who uses the service for their private purposes, outside the scope of their business activities or occupation. Consumers can use the contacts that are available here.

10.2. The contract is concluded in English, is stored in electronic form with GTS Alive Group and is not publicly accessible.

10.3. The technical steps in connection with the conclusion of the contract are as follows: by downloading the Application and accepting the Terms of Use, a contract for the provision of the Application services is concluded. The contract is governed by these Terms of Use.

10.4. GTS Alive Group is not bound by any code of conduct.

10.5. The contract may only be terminated in the manner specified in these Terms of Use and always without giving a reason.

10.6. GTS Alive Group hereby informs the consumer of the existence of an alternative consumer dispute resolution body, i.e. the body specified here.

10.7. If the consumer believes that GTS Alive Group has violated the consumer’s legal rights, they have the right to submit their complaint to the supervisory authority. Information about the supervisory authority is available here.

10.8. The User has the right to lodge a complaint with GTS Alive Group.

10.9. GTS Alive Group has appointed an authorized person to receive complaints and this person receives complaints at the following contacts.

10.10. GTS Alive Group shall always confirm electronically that a complaint has been registered.

10.11. In case of recurring complaints, the authorized person is responsible for discussing the issue with their supervisor.

10.12. GTS Alive Group shall handle complaints without undue delay and in any case within 30 calendar days.

10.13. The User shall be informed about the way the complaint is handled electronically, always within 30 calendar days from the receipt of their complaint. In case it is necessary for the effective exercise of User’s rights, GTS Alive Group shall inform the User about any other rights.

10.14. The consumer has the right to withdraw from the contract in cases foreseen by the applicable legislation.

11. Final Provisions

11.1. The operation of the Application and the Terms of Use shall be governed by the laws of the Czech Republic.

11.2. Any dispute that cannot be resolved amicably shall be decided by a competent court of the Czech Republic.

11.3. The User may contact the supervisory authority with a complaint at the contacts listed above.

11.4. If the Application contains any links to third-party websites, applications/software or other services, GTS Alive Group shall not be responsible for their contents or such links.

11.5. These Terms of Use are effective as of 21 August 2025; if there are substantial grounds, GTS Alive Group may amend these Terms of Use, with effect from electronic notification thereof. If the User does not agree with such amendment to these Terms of Use, he or she may terminate the contract for the use of services.
